1. Acceptance of Terms

By downloading, installing, or using the MyBenAI mobile application (the "App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the App.

2. License Grant

RoboMiri grants you a limited, non-exclusive, non-transferable, personal license to download and use the App on your mobile device(s) for personal, non-commercial purposes only. This license is granted upon payment of the one-time $2 purchase price.

What You Get: You may use all features of the App indefinitely. You own your copy of the App; you do not own the underlying software or technology. Future updates and improvements to the App are included in your license.

Restrictions: You may not:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Copy, distribute, or resell the App or any license
• Remove or alter any copyright, trademark, or proprietary notices
• Rent, lease, or lend the App

3. Acceptable Use

You agree to use the App only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the App. Prohibited behavior includes:

• Harassing or causing distress or inconvenience to any person
• Using the App to create, transmit, or distribute illegal content
• Attempting to gain unauthorized access to the App's systems or networks
• Interfering with the normal operation of the App
• Using the App for any purpose that violates applicable laws or regulations

The AI models within MyBenAI may produce inaccurate, biased, or harmful content. You are responsible for reviewing and fact-checking any output. RoboMiri is not liable for the content generated by the AI.

4. Intellectual Property Rights

RoboMiri owns: All intellectual property in the App, including the software, source code, user interface, algorithms, and design. The AI models and their underlying weights are licensed from third-party providers and remain the property of those providers.

You own: All content you create, input, or generate using the App, including conversations, documents, and images. You grant RoboMiri permission to use this content solely to improve the App and train future models, only to the extent it is anonymized and does not contain personally identifiable information.

Opt-Out: If you do not wish to have your data used for training or improvement, toggle "Offline Mode" or disable analytics in App settings.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ROBOMIRI DISCLAIMS ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will meet your requirements or expectations
• Warranties that the App will be uninterrupted, error-free, secure, or free of defects
• Warranties regarding the accuracy, completeness, or reliability of AI-generated content

Your use of the App is at your sole risk. You are responsible for backing up any data stored on your device.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROBOMIRI SHALL NOT BE LIABLE TO YOU FOR ANY:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or anticipated savings
• Business interruption or loss of business opportunity
• Loss caused by the App crashing, freezing, or producing inaccurate content

This limitation applies even if RoboMiri has been advised of the possibility of such damages. Your exclusive remedy for dissatisfaction with the App is a refund of the purchase price, subject to the refund policy of your app store.

7. Purchase & Refunds

Pricing: MyBenAI is a one-time purchase for $2 USD. No subscription, no recurring charges.

Payment: Payment is processed by the app store (Google Play or Apple App Store), not by RoboMiri. Your payment information is governed by the app store's terms and privacy policy.

Refunds: Refund eligibility is determined by your app store's standard refund policies. You must request refunds through your app store within the applicable window (e.g., Google Play offers refunds within 15 minutes to 48 hours of purchase; Apple's App Store has a 14-day window). RoboMiri does not directly process refunds. Contact your app store's support for refund requests.

Charges Displayed: Prices displayed on the website or app are in USD. Your actual charge may vary based on currency conversion rates if you pay in another currency.

8. Termination

By You: You may stop using the App at any time by uninstalling it from your device. No notice required.

By RoboMiri: RoboMiri may revoke your license to use the App if you violate these Terms. Upon revocation, your right to use the App ceases immediately.

Data Upon Termination: All data is stored on your device. When you uninstall the App or clear app data, all data associated with the App is deleted from your device.

9. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be exclusively resolved in the courts of Rotterdam, Netherlands.

10. Changes to These Terms

RoboMiri may update these Terms & Conditions at any time. Changes will be posted on the mybenai.com website and will become effective upon posting. Your continued use of the App after changes have been posted constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically for changes.
